A day after the special branch registered a complaint of provocation with intent to cause riots against Neelam Divakar Gorhe (55),Shiv Sena Member of Legislative Assembly (MLC),and Milind Keshav Narvekar (42),personal assistant to Sena executive president Uddhav Thackeray,the duo surrendered before the court of judicial magistrate first class R L Wankhade on Thursday.
They were released on bail against a surety of Rs 15,000 each. Gorhe and Narvekar filed surrender applications before the court around 2.30 pm through senior advocate Shrikant Shivade.
An hour later,Gorhe from Pune and Narvekar from Mumbai appeared before JMFC Wankhade. The court room was packed with Sena and BJP supporters including Kothrud MLA Chandrakant Mokate,corporator Shyam Deshpande,Purandar MLA Vijay Shivtare and BJP city chief Girish Bapat.
The court granted the duo magisterial custody till January 12 after which they immediately submitted bail applications through Shivade.
The bail application states that the two accused have been prosecuted under Indian Penal Code (IPC) Section 153 (provocation with intent to cause riot),120B (criminal conspiracy) read with Section 34 (acts done by several persons with common intention).
The offence under Section 153 of IPC (the principal offence) is bailable. Therefore,offence under Section 120B of IPC,which is actually not bailable,also becomes bailable, Shivade said in court.
Since it is a bailable offence,there is no need to call the say of the investigating officer or the assistant public prosecutor, he added. The court then ordered the release of Gorhe and Narvekar on surety of Rs 15,000 each.
Earlier,both of them submitted before the court that at that time they had no surety but would submit the solvent surety within two days. They requested that during this period,they may be released on cash security. However,by 5.30 pm,they submitted the surety before the court.
Speaking to the media after the court procedures,Gorhe said: Just as we presented the truth and judicial side of the issue to the public,we shall also do so before the court. She added that they will now present details of the case before party chief Bal Thackeray and executive president Uddhav.
Gorhe denied that the Thackerays knew anything about the complaint before it was filed. She said they got to know about it only through the media.
