Five months after his arrest,the Pune unit of the Maharashtra ATS on Tuesday submitted draft charges against German Bakery blast accused Mirza Himayat Baig in the court of special judge Usha Thakare.
Baig has been charged under Indian Penal Code,sections 302 (murder),307 (attempt to murder),120B (criminal conspiracy) of the Indian Penal Code (IPC) and relevant sections under sections 10A,10B and 16 (1) (a) of the Unlawful Activities Prevention Act,1967. The punishment under these sections can range from life imprisonment to death.
Meanwhile,defence counsel senior advocate Abdul Rehman submitted his objection to the court regarding admission of various documents forged in the name of Baig as supplementary evidence.
On February 22,assistant commissioner of police,ATS,Vinod Satav had submitted Baigs fake caste and domicile certificate from Beed,blank forms of Ambejogai Regional Transport Office (RTO) bearing RTO stamps and ration card bearing Beed address to the court,details of calls made by Baig from his Tata Indicom and Vodaphone numbers corroborated by their respective nodal officers along with 161-page supplementary chargesheet in Aurangabad Arms Haul case 2006 in which 21 accused linked to Lashkar-e-Toiba (LeT) were arrested.
Rehman stated that these documents dating between 1995 and 2005 are very old and had no relevance whatsoever to the German Bakery blast case. He also submitted that there are no complaints lodged by respective authorities that these documents relating to their office were forged.
Moreover,Baig has not been made accused in the Aurangabad case, he said.
Thakare argued that there is substance in the documents submitted and may be considered at the time of trial. The court admitted the documents as per the Criminal Procedure Code provision. Special Public Prosecutor (SPP) Raja Thakare submitted the draft charges to the court. Arguments on these draft charges will be held on March 18.
