TISS student returns to testify in gangrape case

The 24-year-old US national and student of the Tata Institute of Social Sciences has deposed against the six men accused of gangraping her in April 2009.

The 24-year-old US national and student of the Tata Institute of Social Sciences (TISS) has deposed against the six men accused of gangraping her in April 2009. The victim,who had flown back to the US soon after the incident,appeared before the the Sewree fast track court on Wednesday. The court will continue recording her deposition on Thursday as well.

All six accused— Vinamra Soni,Harshvardhan Yadav,Jashkaran Bhullar,Anish Borkataki,Dev Colabawala and Kundanraj Borgohain— were also present in the court. They are facing trial under section 376 (g) of the Indian Penal Code (IPC) that deals with the offence of gangrape.

The case dates to April 2009 when the accused first met the victim at a pub near TISS and then took her to Borgohain’s flat in Andheri. The victim in her statement to the police had alleged that she realised that she had been gangraped when she woke up in the morning. Soon,an FIR was lodged by the Trombay police and the six men were arrested.

Later,Borgohain had approached the Bombay High Court seeking discharge from the case. But his plea was turned down by the court. The High Court observed that Borgohain’s involvement in the case could be heard during the the trial. However,he has been out on bail since September 2009.

The other accused have been in custody since their arrests.
