Sheena Bora murder: Decision on Peter’s bail plea on February 12

The court has kept the application for an order on February 12.

THE SPECIAL CBI court will decide on the bail application filed by Peter Mukerjea on February 12. The arguments by the CBI and Mukerjea’s defence continued in the special court on Saturday with the defence claiming there was no incriminating evidence to prove that Mukerjea was part of the conspiracy with his wife Indrani to kill his step-daughter Sheena Bora.

The defence argued before the court that Mukerjea was not opposed to Bora’s relationship to his son Rahul. “A text message was sent through the driver’s phone to Rahul in October 2011 congratulating the two on their engagement,” argued senior counsel, Amit Desai before the court. He argued that the CBI’s claim that Peter and Indrani’s trip to London days before the murder and his return to India after the murder showed conspiracy, could not be seen as incriminating evidence.

The CBI opposed the bail plea. “When a chargesheet is yet to be filed, bail should not be given to him. There is enough material on the past incidents of when he travelled abroad and his return to the country after the murder, based on which one cannot say that there was no intention or conspiracy,” said additional solicitor general Anil Singh, representing the CBI. He added that the theory Peter came to know about the murder only after the driver was arrested, could never be accepted.

The court has kept the application for an order on February 12.
