Rakhi Sawant moves Bombay HC challenging outrage of modesty, defamation case filed by model in 2022

Actor Rakhi Sawant recently moved the Bombay High Court seeking quashing of the defamation and outrage of modesty case filed by a model against her last year. The model had complained that Sawant made her ‘inappropriate’ videos and photos viral and that the video shown to the media was ‘sexually explicit’. However, Sawant claimed that the woman complainant had filed a case against her “driven by a desire for revenge”.

The plea by Sawant filed through advocate Ali Kaashif Khan Deshmukh states, “The false accusations and defamatory statements made by the complainant not only cause personal distress but also ruin Sawant’s once successful career. It is evident that the complainant holds a grudge and filed the false FIR as an act of revenge.”

Sawant was booked under Sections 354(A) (outraging modesty of a woman), 500 (defamation), 504 (intent to provoke breach of peace), and 509 (insulting modesty of a woman) of the Indian Penal Code along with Section 67(A) of the Information and Technology Act, among others.

The petitioner claimed that she and the complainant had amicably resolved all disputes, however, the pendency of the FIR was nothing but a “tactic” by the complainant to waste judicial time.

She claimed that Section 354A of the IPC could not be invoked against a woman as it was applicable against a man. She sought quashing of the FIR and the chargesheet filed on October 18, 2023. The HC will hear the plea in due course.

Earlier, on April 17, 2023, a single-judge bench of Justice Anuja Prabhudessai had granted anticipatory bail to Sawant in the case noting that her custodial interrogation was not required and had asked her to cooperate with the probe. In March this year, the HC directed the police to take necessary steps to delete the video concerned from YouTube and other social media platforms.
