Professors need PhD for extension: HC

Bombay High Court on Friday upheld a state government resolution stipulating that professors applying for extension of service must fulfill certain conditions,including a PhD.

The Bombay High Court on Friday upheld a state government resolution stipulating that professors applying for extension of service must fulfill certain conditions,including a PhD.

A division bench of Justices B H Marlapalle and Nishita Mhatre gave the verdict in response to a petition filed by a number of professors challenging the resolution. “We have no doubt in our mind that the state government is not prevented from fixing the age or imposing additional conditions so as to maintain higher standards,” Justice Marlapalle said. However,they asked the government to consider allowing some relaxation for professors covered under the career advancement scheme (CAS).

“It would not be possible for the court to hold that the state government has acted illegally. If the state has,in its wisdom,framed a particular academic policy,the scope of interference is very limited,” Justice Marlapalle said.

Earlier,arguing for the petitioners,lawyer Mihir Desai had said professors should be allowed to continue in service if they are competent. Government pleader Sandeep Shinde said the condition of a PhD is not unreasonable. He also cited a survey that showed over 50 per cent of professors who have applied for superannuation had a PhD.
