The government has given its final approval for a deemed conveyance for housing societies whose builders have not executed the conveyance deed,a move that will bring relief to over 60,000 housing societies in Mumbai and several more all over the state.
With the Maharashtra Ownership Flats (Amendment) Rules,2009 coming into effect immediately,over 80 per cent of housing societies in Mumbai will no longer be at the mercy of developers when it comes to getting the conveyance deed transferred to the societys name.
MHADA vice-president Gautam Chatterjee,who is due to take charge as the state housing secretary Tuesday,confirmed the rules were approved by the Chief Minister Monday. Housing societies would now be able to get a conveyance deed for their building and land within a maximum of six months of applying to the competent authority. A conveyance deed would ensure the right to redevelop the society,the open spaces or any additional construction rights vests entirely with the society.
Besides deemed conveyance,in case of large layout plots,the new set of rules states the builder cannot withhold conveyance to residents on the ground that he will do so only after the entire plot is developed,a process which usually translates into an endless wait for residents.
