Two days after being sent to judicial custody,drunken driving accused Nooriya Haveliwala (27) moved a bail application in the Sessions Court on Monday. Haveliwala has been behind bars since her arrest on January 30 for mowing down an on-duty traffic policeman and a biker and injuring four police constables in an accident at Marine Lines.
Nooriya,a beautician by profession,was on her way back to her Colaba residence from Opera House when she lost control over her Honda CRV and hit a bike and a police jeep. Biker Afzal Maknejia (35),who had been stopped at random by police on a drive to check drunken driving,was killed on the spot while assistant sub inspector Dina Nath Shinde (40) succumbed to injuries at a hospital.
Haveliwala has been booked for culpable homicide not amounting to murder and rash and negligent driving,and has been lodged at the Byculla womens prison.
In the bail application,Haveliwalas lawyers stated that she had no intention of causing the accident,and that her custody was not required any more.
Meanwhile,Shailesh Jadhav,one of the constables injured in the accident,filed an intervening application opposing Haveliwalas bail plea. Jadhav stated that it was a serious offence and Haveliwala should not be let off.
The court has directed the prosecution to file its reply by February 16.
