A sessions court on Tuesday sentenced a 37-year-old Nigerian to five years rigorous imprisonment for biting a police constable on duty at the J J Marg police station last year. The court convicted the accused under charges of grievous hurt.
Sessions judge R N Ladda convicted Ega Michael,who had stormed into the J J Marg police station on the afternoon of March 13,2008. A fine of Rs 3,000 was also imposed on him.
According to the officers present when the incident took place,some policemen on duty thought he was asking them to arrest him,while others believed he was trying to escape from the nearby Nagpada area after being found with contraband. Some other officials thought he was under the influence of drugs.
Policemen tried to calm him down by trying to grab him by his shoulders. However,an agitated Michael bit off the ear of constable Ankush Patole,who in his complaint had said that it was a grievous injury caused to him. The J J Marg police arrested Michael under section 333 (causing grievous hurt to a public servant to deter him from his duty),of the Indian Penal Code (IPC) and later he was lodged at the Arthur Road jail.
After being in custody for over 70 days,Michael was granted bail by a sessions court on May 22,2008,but Michael refused to execute the bail order,claiming he felt threatened by the people of Nagpada,from whom he was running away when he was arrested by the police.
During the trial,Michaels lawyer pointed out that there were contradictions in reports about whether Michael had bitten off the top portion of Patoles ear or the lower half. However,the court found enough evidence in witness testimonies and other documents to find Michael guilty and he was convicted under section 323 (causing grievous hurt) of the IPC.
