Artist married to German moves HC for childs school admission
A sixty-year-old artist married to a German national sought the Bombay High Courts intervention for securing a Person of Indian Origin status for his five-year-old son so that the child can get admission to a school here.
A sixty-year-old artist married to a German national sought the Bombay High Courts intervention for securing a Person of Indian Origin (PIO) status for his five-year-old son so that the child can get admission to a school here. Petitioner Dhananjay Paranjpe alias Artist Mumbiram got married to 29-year-old German Nadine alias Vrinda in 2002. After their son Hansraj,who is almost five-years-old,was born,the couple started making efforts to get a long term visa and a PIO status for the child. Vrinda has already got a five year visa.
However,following the courts intervention the authorities have issued X visas for the child and the mother.
A division bench of Justice Ranjana Desai and Justice Rajesh Ketkar on Wednesday asked the state as well as the Foreigners Registration Office whether the child can be given admission,if he possesses an X visa.
Additional Public Prosecutor Usha Kejriwal produced a government circular which stated that admission can be given to such visa holders.
The state also submitted that the visa can even be converted to a student visa,if necessary applications are made. The court has adjourned the hearing for a week for the authorities to seek instruction for expediting the process for getting PIO status.
The court also wanted to know by when Artist Mumbiram would make the necessary applications. The judges were,however,annoyed as the petitioner said he will have to consult with his wife for the same. The court also expressed concern for the childs education as he was almost five-year-old.
Mumbiram stated that they have been living in the shadow of deportation as the child was staying here on a tourist visa. The couple,who got their second child recently,have been living in Alibaug since October 2006.
Mumbiram,who has obtained Doctor of Philosophy and degree in Mathematical Economics from the University of California,stated that when Hansraj was a year-and-a-half-old,they had applied for a five year visa,three months before their childs visa expired.
However,the five year visa was not processed and the child had to go to Germany and later came back on a tourist visa,on which he stayed here till the X visa was issued.
