Adarsh scam: Phatak,Tiwari seek bail

A WEEK after seven accused arrested in the Adarsh housing society scam were granted bail by the special Central Bureau of Investigation (CBI) court,the two others also moved bail applications.

After the CBI failed to file the chargesheet in the stipulated 60-day span since their arrests,former municipal commissioner Jairaj Phatak and former state information commissioner Ramanand Tiwari moved for bail.

Both have been in jail since their arrest on April 3.

They have been behind bars for 60 days and the chargesheet has not been filed yet. The application is filed on similar grounds as other accused,who were released on bail by the court last week, said Phataks lawyer Swapna Kode. The matter will be heard on Wednesday.

Last week,the CBI court granted bail to seven of the other accused on the same grounds. Special CBI judge M V Kulkarni granted bail to Maj Gen (retd) A R Kumar,Maj Gen (retd) T K Kaul,Brig (retd) M M Wanchu,former collector Pradeep Vyas,former sub-divisional superintendent of the Defence Estates Office R C Thakur (one of the main promoters of the Adarsh housing society),former deputy secretary of the state (Urban Development Department) P V Deshmukh and former Congress MLC Kanhaiyalal Gidwani (the chief promoter of Adarsh).

Their 60-day period ended earlier as they were arrested on March 20 and 21.

All accused have been charged with criminal conspiracy under the IPC and under various sections of the Prevention of Corruption Act and the Benami Transactions (Prohibition) Act.
