UP sets up security commission

Ahead of its appearance in the Supreme Court with a compliance report on the court’s order on police reforms.

Ahead of its appearance in the Supreme Court with a compliance report on the court’s order on police reforms on Monday,the Uttar Pradesh government has constituted the state security commission and also fixed two years as minimum tenure for the Inspector General (IG),Deputy Inspector General (DIG),Superintendent of Police (SP) and the in-charge of the police station.

A government order in this regard was issued on Friday,said the Secretary (Home),Deepak Kumar.

The Supreme Court had warned the governments of Uttar Pradesh besides Maharashtra,West Bengal and Karnataka over non-compliance of its order issued earlier related to police reforms. The chief secretaries of these states were ordered to file the status report about the compliance of the order before the court on December 6.

The apex court bench comprising the then Chief Justice YK Sabharwal,Justice CK Thakker and PK Balasubramanyan had issued the order on September 22,2006 directing the state governments to follow certain guidelines related to police reforms after hearing the petition of former DGP of UP Prakash Singh.

The apex court order had directed the states to constitute the State Security Commission to ensure that the state government does not exercise unwarranted influence or pressure on the state police and the police can act according to the law and the constitution. The court had suggested that either chief minister or home minister should chair the commission and the DGP of the state be made the ex-officio secretary.

The court had also said that other members of the commission shall be selected in such a manner that it is able to function independent of government control.

In compliance of the apex court order,the UP government on Friday constituted the commission with Chief Minister Mayawati as chairman,DGP Karamvir Singh as secretary while the members included the leader of Opposition in state Assembly Shivpal Singh Yadav,chairman of the state SC/ST Commission Ram Chandra,chairman of the UP Police Reforms Commission Ram Kumar (ex-IAS officer) and Vice-Chancellor of Mahamaya Nagar Technical University SK Kak.

As per the order issued by the UP government,the tenure of two years has been fixed for the officers of the rank of IG,DIG,SP and the in-charge of the police station also.

Meanwhile,when inquired from the petitioner,Prakash Singh,he said,“I am not aware of any such order from the UP government. The chief secretary of the state government has been ordered to file the report before the Supreme Court on Monday. I would be able to comment over it after the court proceeding that day.”
