Citing the conditions the Portuguese government had put while extraditing Abu Salem in November,2005,the gangsters lawyer today requested the Lucknow CBI court for exempting his client from various sections of the IPC in the passport forgery case. Salem too attended the hearing on Tuesday.
The CBI,however,opposed the plea and asked for permission for further investigation in the case. The next hearing is due on April 13 in the court of CBI Special Judge Saif Ahmed.
Salem,presently lodged in Mumbais Arthur Road jail,had first appeared before the court on March 17.
Salems lawyer Aamir Naqvi said,The CBI had registered the case against Salem,his wife Samira Jumani and a broker Pervez Alam under Sections 420,467,468,120-B of the IPC and the Passport Act in 1997. The named persons were held accused for forging documents and procuring passports in fake names from the Lucknow regional passport office on July 6,1993. The Portuguese government,while handing over Salem,had put a condition that he would not be booked under the Passport Act,420 (cheating),467 (forgery of valuable security) and 468 (forgery for purpose of cheating).
Therefore,Naqvi said,he has requested the court to exempt Salem from trial under these IPC Sections.
