One more BSP MLA disqualified from House for defection

The speaker of the state Assembly,Sukhdeo Rajbhar,on Tuesday disqualified BSP MLA Sher Bahadur under the anti-defection law for joining the Samajwadi Party.

The speaker of the state Assembly,Sukhdeo Rajbhar,on Tuesday disqualified BSP MLA Sher Bahadur under the anti-defection law for joining the Samajwadi Party. Sher Bahadur represented Jalalabad constituency in Ambedkar Nagar district.

He is the second BSP MLA who has been disqualified for defection. On September 17,the Speaker Rajbhar had disqualified Fareed Mahfooz Quidwai after he joined the SP. Quidwai was elected from Massauli.

State BSP president Swami Prasad Maurya had moved a petition before the Speaker,seeking Sher Bahadur’s disqualification after he joined the Samajwadi Party.

The Speaker said Sher Bahadur has been disqualified under “Para 2 (1) of the Tenth Schedule of the Constitution,” which deals with disqualification on the grounds of defection of a member of legislative assembly if he voluntarily gives up the membership of his political party. The order is effective retrospectively from July 25,the day Sher Bahadur had joined the SP.

Sher Bahadur expressed unhappiness over the Speaker’s decision and said he would challenge it in court.

On Tuesday,the Speaker received another petition from Maurya,requesting to disqualify BSP MLA Jitendra Singh Babloo who joined the Peace Party last week.

Petitions for disqualification of two other BSP MLAs,Bhagwan Sharma alias Guddu Pandit and Krishna Kumar alias Satish Verma,who also joined the Samajwadi Party,are pending with the Speaker.
