The hearing in connection with the bail plea of Nupur Talwar, mother of slain Noida teenager Arushi Talwar, continued before the Allahabad High Court today with the defence advancing its arguments in the case. The matter will continue to be heard on Wednesday.

Nupur, along with her husband Dr Rajesh Talwar,is facing prosecution in connection with the murder of their daughter and their domestic help Hemraj. The incident had occurred on May 16,2008,in Noida.

The hearing is going on before the single judge bench of Justice Arvind Kumar Tripathi. “Our main contention is that the CBI has already filed a closure report in which it says that it does not have evidence to link the petitioner with the crime though there is suspicion. When there is no direct evidence against the petitioner,it is a fit case for bail,” said V P Srivastava, counsel for the petitioner.

Nupur had surrendered before the court of Chief Judicial Magistrate on April 30 and had since been in judicial custody. Counsel for CBI Anurag Khanna said that the CBI would forward its arguments on Wednesday.

The CBI had filed a closure report before a Ghaziabad court in December 2010 saying there was suspicion on the Talwar couple but it did not have any direct evidence or motive to link them with the deaths of Arushi and their domestic help Hemraj. However, the court had rejected the report and directed the Talwars to face trial. They had unsuccessfully sought relief from the Supreme Court.
