The Independent MLA from Jasrana constituency of Ferozabad district,Ram Prakash Yadav,who was facing charges of kidnapping for ransom since 2005,was remanded in judicial custody after he appeared before the court of Additional Session Judge-IV on Wednesday.
The legislator was out on bail after his initial arrest but he was not attending the hearings. Hence,the court had issued a Non-Bailable Warrant against him in February 2009.
Interestingly,an application from the state government for the withdrawal of the case against the legislator has been pending with the court since January,2008.
District Government Counsel (DGC) Ramvir Singh said the court had not rejected the application yet and had summoned the complainant to give his view on the withdrawal of the case. The statement of the complainant is yet to be recorded.
Ferozabad DM N Ravi Kumar said : The application for the withdrawal of the case against the MLA was filed in the court in 2008 after it was endorsed by the law department and the government.
According to him,the legislators counsel Sher Singh Rajput produced him before the court today without informing the DGC or the district administration in this regard.
Ferozabad Superintendent of Police Udai Pratap said 12 criminal cases are pending against the legislator in the district.
Principal Secretary (Home) had sent two separate letters to the district magistrate in January,2008 stating the decision of the government about withdrawal of 10 cases against the legislator. The letters also included a reference of the law department.
The SP added that the then district magistrate had received the applications but the court did not take cognizance of those.
The Home department had also not been informed about the status of the withdrawal of the applications in the court so far.
The SHO of Jasrana police station,Awadhesh Kumar Mishra,said that a case of kidnapping for ransom had been registered against the legislator and four others at the police station on May 14,2005.
Hoti Lal of Sasni area in Aligarh district had lodged an FIR alleging that Ram Prakash Yadav and his associates had kidnapped his son Lakshman Prasad and his friend Atar Singh.
The complainant had alleged that the accused had demanded ransom for the release of the victims.
Both the youths,however,returned home later,the SHO added.
