Bhopal court issues warrant against BSP MLA in murder case

A Bhopal court has issued non-bailable warrants against Brijesh Saurabh,BSP legislator from Gadwara constituency in Pratapgarh district of UP,in a murder case dating back to 2005.

A Bhopal court has issued non-bailable warrants against Brijesh Saurabh,BSP legislator from Gadwara constituency in Pratapgarh district of UP,in a murder case dating back to 2005. The murder took place in Pratapgarh,but the Supreme Court shifted the trial to Bhopal last year on a petition by the victim’s family,stating that they will not get justice in UP.

R G Singh,Chief Judicial Magistrate of Bhopal,issued the warrants after the MLA did not appear before the court despite several summons. The warrants have been sent to Pratapgarh police for execution.

Station Officer of Antoo Atul Kumar Tiwari said they got the court warrant against MLA in the last week of August and since then they have been searching for him. He said they conducted raids at the MLA’s houses in Pratapgarh town and Kapasi village.

Advocate Raghuvendra Singh was shot dead while he was returning home on a bicycle in Pratapgarh’s Antoo area on June 24,2005. His elder brother Surendra Pratap Singh lodged an FIR against Brijesh Saurabh,who was then BSP worker,his elder brother Mahesh Mishra,cousin Hari Shankar Mishra and driver Gopi.

Surendra Pratap said Brijesh Saurabh had developed enmity with his brother because he had taken up certain cases against the former.

After completing the investigation,the Pratapgarh police filed the charge-sheet against the four accused. Brijesh Saurabh then moved the high court,alleging the investigation was not fair and sought further investigation by another agency.

The court directed Crime Branch-CID to conduct investigation and submit a report. In 2008,the agency submitted its final report. “Before the court could take a decision,the state government moved an application in the local court of Pratapgarh requesting for withdrawal of the case against the MLA,” said Surendra.

Surendra then approached the Supreme Court,seeking transfer of the trial outside Uttar Pradesh,stating that it was not possible to get justice within the state.
