The Calcutta High Court on Friday scheduled the hearing in a PIL on the land distributed by the West Bengal Housing Infrastructure Development Corporation Limited (HIDCO) in Rajarhat for June 10,which means that the issue will come up in the court after the formation of the next government.
The Division Bench headed by Chief Justice Jaynarayan Patel asked Ramaprasad Sarkar,the petitioner,to file additional reply on the affidavit filed by Gautam Dev,state Housing Minister also the chairman of HIDCO.
It is significant to mention here that the acquisition of land by the HIDCO for the Rajarhat Township,a satellite town adjacent to the Kolkata,had become a political issue in the run-up to the assembly elections.
On the other hand Calcutta High Court admitted the PIL in the September 2010,in which it was alleged that the plots were distributed under the special quota of chairman Gautam Deb,which he could not do legally.
As HIDCO is run by the government,it could not distribute land under the special quota of the chairman who is also the Housing Minister and it violated a Supreme Court order.
During Fridays hearing,Amitav Das,counsel of Sarkar,said how the land for the township was acquired without issuing the notification under Section 6 of the Land Acquisition Act,1894. Das pointed out that the affidavit of HIDCO admitted about the distribution of plots under the chairman quota. Das raised the point that the affidavit of the HIDCO also said that plots were distributed under special quota of the Chairman and there was a quota for the political workers also. Das said the HIDCO did not disclose the name of the beneficiaries,who got the land under the chairman quota .
He argued that there was lot of contradictions in the affidavit filed by the HIDCO and Gautam Deb.
