‘MPs maligned judiciary during impeachment’

Comments on the judiciary during the impeachment motion against Justice Soumitra Sen in the Rajya Sabha have not gone down well with some legal minds in West Bengal.

Comments on the judiciary during the impeachment motion against Justice Soumitra Sen in the Rajya Sabha have not gone down well with some legal minds in West Bengal.

Justice Chittotosh Mukherjee,former Chief Justice of the Bombay High Court,said that the way some MPs attacked the judiciary or tried to malign it could not be accepted. The debate was on impeachment of a judge,but the members maligned the judiciary in the process,Mukherjee said.

A section of advocates of the Calcutta High Court felt that the MPs could say anything as there was no scope for “contempt proceedings” by the court. Avocate Asish Roy,former general secretary of the Bar Association of the Calcutta High Court,said the MPs had liberty to pass comments in the House. However,their remarks against the judiciary or judges during the debate were unethical.

Advocate Arunava Ghosh said the remarks of Ram Jethmalani during the impeachment proceeding would have amounted to contempt of court outside the floor of the House.
