The Calcutta High Court Friday directed the police to take necessary steps to return a 105-year-old man to his own house, who was ousted by his son last year.
Sudhir Ghosh, a resident of Krishnanagar in the Nadia district, had lodged a complaint with the local police station regarding him being ousted from his house by his son. The local police did not take any action. So the old man then approached the High Court.
Justice Dipankar Dutta directed the police to take necessary steps and also told the police to make sure that the old man can stay in his own house peacefully.
Advocate Uttam Mazumdar, counsel of Ghosh, said that Ghosh has two sons and three daughters and he was staying with his one unmarried daughter in his two-storied house at Krishnanagar. His eldest son was also living with his family in the same house.
Last year Ghosh had gifted the ground floor to his unmarried daughter, aged about 55 years. Following which his son created disturbances in the house. At last, Ghosh and his unmarried daughter were driven out of the house by the son. Then the old man lodged a complaint with the Krishnanagar police station. They took shelter in the house of one of his married daughters, seeing no other option.
Mazumdar said that Ghosh was working in the state health department and he took the VRS long ago. His eldest son got service against the VRS of his father. But he drove out his father from his own house on the issue of property.
The old man approached the Calcutta High Court against inaction of the police. Mazumdar Friday pleaded that apart from law, the case must be considered on a humanitarian ground.
