Builders fail to get NOCs, leading to delay in ongoing projects in Noida, Greater Noida: Minister

The state government is not responsible for the delay in the registration of ongoing residential projects in Noida and Greater Noida, Uttar Pradesh Minister Ravindra Jaiswal said on Sunday.

Several projects have been pending a long time due to the ongoing disputes between builders and the local development authorities over the no-objection certificates (NOCs), said the Minister for Stamp and Court Registration Fees (Independent Charge). “My department has no role in holding up the process,” he clarified.

Addressing the reporters, he said that the Registry department processes registrations for homebuyers without delay. “In Gautam Buddha Nagar, there are three local development authorities that allot land to builders after collecting dues and passing project layouts. The dispute arises when builders fail to obtain an NOC due to pending payments or compliance issues with these authorities,” said the Minister in Lucknow.

When contacted, the Chief Executive Officer, Greater Noida Industrial Development Authority (GNIDA), NG Ravi told The Indian Express that builders in many cases do not get the NOC as they fail to pay the authority. “The property is leased. It is a tripartite agreement between the builder, the seller and the authority. To get the NOC, a builder needs to clear the dues,” said the CEO.

The CEO said that the builders in Greater Noida have been going overboard. “They take up huge parcels of land and then fail to complete the project,” he said.

The Noida Authority CEO did not comment on the matter.

Meanwhile, Annu Khan, President, Noida Extension Flat Owners & Members Association (NEFOMA), said that the delay in NOC in projects has been because of the nexus between the builder and the authority and homebuyers were the ultimate sufferers. “The land is owned by the authority. It is the responsibility of the authority to examine the capacity of the builder developing the project. If they did not have the capacity, why did the authority give the land,” he asked.

Khan said that corruption was to be blamed and people have ultimately suffered over years.

Explaining that the NOC is a certificate that states that all the work relating to a building, including the completion of tower, gyms and park or swimming pool, is complete and the homebuyers can opt for the registry of the flats, Khan added, “A builder can sell the flats to homebuyers before getting the NOC, but the buyers cannot get the flat registered in his or her name.”
