The Delhi High Court Wednesday sought responses from Jamia Millia Islamia, University Grants Commission and Centre in a public interest litigation seeking 10% reservation for Economically Weaker Section (EWS) category students from the academic year 2023-24 onwards as per the 103 Constitutional Amendment Act, 2019.
A division bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad issued notice on the PIL directing respondents to file responses by April 18, the next date of hearing.
The HC further issued notice on the interim relief application that seeks a direction to the university to not proceed with the admission process for 2023-2024 till the PIL’s final disposal. The HC tagged the matter along with a batch of pleas, which pertain to the issue of the status of the university as a minority institution.
The PIL moved by a Delhi University law student states that though Jamia was established in the year 1920 in Aligarh, the parliament passed the Jamia Millia Islamia Act, 1988 through which the university was incorporated as a central university.
The plea states that the university’s prospectus for the academic year 2023-2024 invites applications for admission in its different undergraduate and graduate courses without making any provision for the 10% EWS reservation.
