CJ urged to keep 2 HC judges away from cases involving Centre

Inder Singh Saroha said he is making the suggestions due to allegations about relatives of the HC judges being given preference in a judicial exam.

Inder Singh Saroha said he is making the suggestions due to allegations about relatives of the HC judges being given preference in a judicial exam.

Stating that “it has been openly published” that Union Law Minister Sadananda Gowda has asked for an enquiry into the Judicial Services Examination in 2014, “particularly the aspect of the kith and kin of two sitting High Court judges clearing the said examination”, Saroha wrote, “This exam was conducted by Delhi HC and 80 posts were to be filled up as per the ad. However, to the utter surprise of most of the eligible participants, only 15 participants have been declared as qualified for the services, who are directly or indirectly related to the judges.”

Saroha goes on to suggest that the judges either not be assigned cases with the Union government’s involvement, pending an inquiry, or be shifted out of Delhi entirely.

“So to maintain the faith and confidence in the judiciary, it is absolutely necessary that the two sitting HC judges, whose kin have been reported to have cleared the said examination, should not be assigned cases in which union government is one of the parties as these judges could be influenced by the union government, which is stated to have ordered an enquiry into the matter. Or if possible judges be posted out of Delhi so that they may not influence the independent enquiry into the scam,” he stated in the letter.

Saroha told The Sunday Express, “I wrote the letter because the issue of corruption takes the utmost importance, and justice must be seen as being done. For a fair enquiry and the image of the judiciary, these steps must be taken.”
