Was thrashed by constable: Burail Jail undertrial

The matter came to light here on Monday after a 24-year old,Shashi Kumar,who is lodged at the jail in a couple of theft cases,moved the court at Panchkula on Monday seeking action in the matter.

Taking note of the application filed in the case,the court of civil judge junior division,Anudeep Kaur Bhatti,on Monday observed that the allegations are of a serious nature and the under trail should be produced before the chief judicial magistrate (CJM) Chandigarh,for necessary action.

Shashi Kumar,who was brought before the court,stated that he was thrashed by a head constable at the jail without any reason. He was earlier arrested by the police for theft cases in Chandigarh registered at the Sector 34 police station.

However,counsel for the complainant,advocate Vikram Chauhan,said that he was being framed in false cases by police and was also tortured at Burail Jail and sought that he should be moved to Central Jail,Ambala.

The court of Anudeep Kaur Bhatti observed that the allegations mentioned in the application are of a serious nature and pertain to the atrocities by police personnel on him. The court directed that since Burail Jail falls in the territorial jurisdiction of Chandigarh,the accused should be produced before chief judicial magistrate (CJM),Chandigarh.

Shashi Kumar was arrested by police in connection with a number of theft cases,including that of a mobile phone, purse and motorcycle and has cases pending against him at the Sector 5 and Sector 20 police stations in Panchkula as well as the Sector 35 police station at Chandigarh.

Kumar told The Indian Express that he was thrashed by a belt by a head constable at the jail and also showed marks of the beating on his back. His mother,Jaswinder Kaur,said that police have slapped false cases against her son. “We had bought a new motorcycle recently which was also shown by police to have been recovered in a theft case. We had to bribe the police to get the motorbike released from them,” she said.

Family members of the accused said that a head constable thrashed him after a fight had started off between two under trials at the jail even as he had no role to play in the fight.
