Chandigarh Consumer Disputes Redressal Commission has directed a showroom in Sector 22 to replace mattresses sold to a Kalka resident and also pay him Rs 5,000 as compensation.
The complainant,Sumer Singh Saini,had earlier approached the UT Consumer Disputes Redressal Forum. President of Consumer Disputes Redressal Forum-I P D Goel and members Rajinder Singh Gill and Dr Madanjit Kaur Sahota had found the complaint false,frivolous and vexatious,and had imposed a penalty of Rs 5,000 on Saini. After the Forum dismissed his complaint,he filed an appeal in the Consumer Commission.
In its reply,a spokesman of the showroom admitted that the mattresses had been sold to Saini. It denied that the mattresses gave a pungent smell soon after use. The spokesman added that it offered to get the mattresses checked,but Saini refused to bring them to the shop. The spokesman said that when the case had earlier come up before the Lok Adalat,the showroom had offered to replace the mattresses or refund Rs 7,875.
After considering the case,the Commission said that Saini had sent a registered notice to the showroom in August 2010,asking it either to replace the mattresses or refund the price. The Commission said that if the showroom was actually ready to replace the mattresses or refund the price,it would have responded to this notice,but it did not do so.
The Commission directed the showroom to replace the mattresses and also give Rs 5,000 as compensation to Saini for the harassment caused to him.
