SC slaps Rs 25,000 fine on Punjab,asks state to give pension to former AAG

The Supreme Court has slapped a penalty of Rs 25,000 on the Punjab government for denying pensionary and other benefits to its former assistant advocate general Suresh Kumar Sharma.

The Supreme Court has slapped a penalty of Rs 25,000 on the Punjab government for denying pensionary and other benefits to its former assistant advocate general (AAG) Suresh Kumar Sharma. A division bench comprising Justice Dalveer Bhandari and Justice Deepak Verma has directed Punjab to award the pensionary and other benefits to Sharma within four weeks.

The directions have been passed on an appeal filed by Punjab wherein it challenged an order dated July 12,2004,of the Punjab and Haryana High Court in which the court had allowed petition filed by Sharma demanding pensionary benefits. The ground taken by Sharma was that his appointment was not in the nature of contract of personal service but as regular government employee. On the other hand,the Punjab government took the plea that the appointment of Sharma was contractual. Showing little conviction in the stand taken by the state,the High Court allowed the petition filed by Sharma. Aggrieved,the state moved the apex court in appeal.

Sharma was appointed as Assistant Advocate General,Punjab,by the order dated April 28,1986. He was appointed as Assistant Advocate General and thereafter he was appointed as Deputy Advocate General and Senior Deputy Advocate General. He superannuated on March 31,2003. Sharma had also contended that some similarly placed persons were granted pensionary benefits .
