The Police Complaints Authority (PCA) has asked the Inspector General of Police to take suitable disciplinary action against a Sub-Inspector of the UT Police for his gross misconduct and abuse of power.
A complaint was made by Rajesh Sharma,a resident of Sector 39 after his brother had met with an accident. The complainant stated that SI Gurmit Singh delayed the registration of a case and kept the vehicle involved in the police station without a seizure memo.
The case dates back to October 9,last year. An accident had taken place between a motorcycle driven by the complainants brother Paveen Kumar and a gear-less scooter driven by Gurvinder Singh in Sector 38 at 11.30 pm. After the accident,a PCR vehicle took both the drivers to GMSH-16 for first aid.
Praveen Kumar wanted to make a compliant to the investigating officer,SI Gurmit Singh,who reached GMSH-16 from Police Station Sector 39. The SI refused to accept the complaint and asked Praveen to meet him in the police station the next day.
Praveen met the SI in the police station. They (Praveen and the complainant) were asked to call Gurvinder Singh as well. The SI was requested to summon Gurvinder. At this,he got furious and rebuked them. SI said that if the scooter-driver is not called,the motorcycle shall remain in the police station, according to the order.
The complainant had stated that the SI was informed that the accident had occurred due to Gurvinders fault. Instead,the SI asked Praveen to apologise and get Gurvinders scooter repaired. After Praveen and his brother agreed settle the matter by entering in to a compromise,the SI refused to release Parveens motorcycle unless a sum of Rs 5,000 was deposited.
It is alleged that the SI pushed him (Praveen) out of the police station. He also refused to give the copy of the Daily Diary Report (DDR) to the complainant. A copy of DDR was later taken under the RTI Act, reads the order.
SI Gurmit in his reply had said that Praveen never contacted him after the accident. After Gurvinder gave his statement on December 24 last year,an FIR was registered. Praveen had asked Gurvinder not to lodge a complaint and accept a compensation, reads the order.
The order states that,SI Gurmit Singh did not summon Gurvinder Singh. He proceeded with the investigation of the case after a complaint was made to PCA and the SI was notified to submit his reply in the same.
SI Gurmit Singh,posted in Police Station Sector 39 had kept a motorcycle at the police station for over three months without registering an FIR or any seizure memo. It was an arbitrary action and wholly malafide in nature, states the order.
