Manufacturer told to compensate three customers for defective mattresses

In his complaint,Sharma had said he bought two pairs of Rose Coir Foams mattresses (popular model),along with two single beds,for Rs 7,425 in July 2008.

Soon after,he found certain disfigured patches on every corner of the mattresses and brought it to the notice of Avtar Furnishers in Furniture Market at Badheri from where he had bought them. The dealer took the mattresses and promised a replacement. However,the complaint said,despite several calls the mattresses were not delivered. It was then that Sharma moved the consumer forum.

Exactly the same complaint was filed by two other city residents,Sukhwinder Singh and Amit Sharma.

In its reply,Avtar Furnishers had pleaded that the mattresses were sent to the Rose Coir Farms,but they were not replaced,and that no other pair of the same quality was available with them to replace the pair.

No representation from Rose Coir Farms made the forum proceed with the case ex parte.

The forum ruled out any deficiency on part of the furniture shop,as the owner had sent the mattresses to the manufacturer for replacement.

“The manufacturers are carrying out service in a negligent and deficient manner,thereby causing harassment to the complainant,and not replacing the defective mattresses surely amounts to deficiency in service,” the forum ruled.

Further,the forum directed the company to pay Sukhwinder Singh Rs 2,100 and Amit Sharma Rs 3,000 as compensation and replace their defective mattresses.
