Public interest litigation challanges notion of assured allotment; body asked to reply by first week of January
The newly launched scheme of the Chandigarh Housing Board (CHB) of 160 two-bedroom flats in Sector 51-A,Chandigarh,has been challenged in the Punjab and Haryana High Court. A division bench comprising Chief Justice Mukul Mudgal and Justice Ranjan Gogoi has issued notices to the UT Administration and Chandigarh Housing Board (CHB) on a public interest litigation (PIL) filed by Jagmohan Singh Bhatti.
The petitioner has sought directions to restrain the CHB from issuing brochure of the scheme and accepting the application forms for the allotment of 160 flats priced at Rs 47 to Rs 50 lakh a unit.
Bhatti has requested the High Court to restrain Administration from releasing brochures till the clause of accepting any number of application forms from a single person is removed/ deleted/ amended/modified as it shall diminish the chances of the allotment of the flats to the general public.
Bhatti has further contended that the offer wherein an individual can apply for more than one application form will encourage and regularise business for the mighty and wealthy persons.
The petitioner has submitted that the said scheme launched by the Administration will defeat the objective for which Chandigarh Housing Board (CHB) has been established. Bhatti has not only sought the removal of certain clauses including the clause wherein a candidate can get an assured flat by paying a certain amount but also quashing of the entire scheme.
Refusing to stay the policy,the High Court has only issued notices to the CHB and asked it to respond by first week of January.
