Chandigarh Admin puts 14 night clubs on notice for violating noise pollution levels

As many as 14 night clubs and bars have been slapped notices by the Chandigarh Excise and Taxation Department for violating noise pollution norms.

These clubs are located in sectors 26 and 7, the main artery of the city. The sectors also house the posh belt of the city.

It was after Chandigarh Senior Superintendent of Police received 81 complaints from residents of the sectors that the action was taken by the department.

Not only the clubs have been asked to reply as to why their licence may not be cancelled but the SSP has also withdrawn their NOCs.

The Excise Department stated that it is in receipt of letters of November 28 and December 6 from the Chandigarh SSP wherein it was specified about the noise pollution being done by the clubs.

As per the said letters from the Chandigarh SSP, the said bars and clubs have been found violating the Noise Pollution (Regulation and Control) Rules, 2000, repeatedly.

It mentioned how the SSP has also withdrawn their NOC/consent regarding operations of the licence at their said premises. The SSP in the letter also requested that appropriate action be taken by the Excise and Taxation Department.

The violators include M/s Kaindal Hospitality (The Vault), SCO-11, Sector-7C; M/s Pristine Hospitality (De’ orra Club), SCO No. 23, Ground Floor, Sector-26, Madhya Marg; M/s JSM SPL Restaurant LLP (Hard Rock Café), SCO No. 34, Ground Floor, Sector 26), Madhya Marg; M/s Rebel Hospitality (Kukuna Club), SCO No. 3A, Sector- 7C; M/s Rabditta Corporates (Kala Ghoda), SCO No. 28, Ground Floor, Sector-26, Chandigarh; M/s GBS Hospitality Pvt Ltd (Bargain N Booze), SCO No. 33, Ground Floor, back portion Sector-26, Chandigarh; M/s The Timeliners (Boulevard), SCO No. 21, Sector 26, Chandigarh; M/s Sans Foods (Ministry of Bar Exchange), SCO No. 41, Sector 26, Chandigarh; and M/s Jaks Enterprises (Culture Club) SCO No. 1, Sector 26, Chandigarh.

Not only these clubs, the SSP also said that the said establishments/licensees have also been found violating the Noise Pollution (Regulation and Control) Rules, 2000.

This includes M/s Urban Bosses LLP (Prankster F & B Campus), SCO No. 47, Sector 26, Chandigarh; then M/s Red Chilly Foods Pvt. Ltd. (Qizo Club), SCO No. 43 Sector 26, Chandigarh; M/s Rock & Storm Hospitality (Brew Estate / Sante Club), SCO No. 25, Sector 26; M/s Infinitude Enterprises (Wild Thyme Sector 7), SCO No. 7, Sector 7, Chandigarh; and M/s S.K. Hospitality (Zeek Club), SCO No. 44, Sector 26, Chandigarh.

Which section allows dept to cancel lincence

According to the department, Section 36 (c) of the Punjab Excise Act, 1914 (as applicable to U.T., Chandigarh) provides the power to cancel or suspend licences, subject to such restrictions as the state government may prescribe, the authority granting any licence, permit or pass under this Act may cancel or suspend it.

What the dept said

The UT department of excise and taxation grants the licensee at the approved premises under the Punjab Excise Act, 1914 (as applicable to UT, Chandigarh) and these licences have been renewed on year-to-year basis and presently has been renewed for the current UT Chandigarh Excise Policy Year 2024-25 up to 31.3.2025.

The licence obligates the licensee to abide by the Punjab Excise Act 2014 and the Rules/Orders/ Regulations/Instructions framed thereunder from time to time as applicable to U.T. Chandigarh, including the U.T, Chandigarh Excise Policy 2024-25, other instructions / orders/ circulars issued by the Excise & Taxation Commissioner-cum-Financial Commissioner, U.T. Chandigarh and the terms and conditions laid by Chandigarh Administration as well as other rules & regulation of the government to include the building regulations as well as the Noise Pollution (Regulation and Control) Rules, 2000 as applicable to UT Chandigarh.
