The Central Bureau of Investigation (CBI) has failed for the second time to investigate a case registered against former top bureaucrats of Chandigarh Administration regarding alleged corruption in the controversial Amusement-cum-Theme Park project. The CBI files its second closure report Wednesday.
During the course of further investigation,no additional evidence emerged against any of the accused. CBI has already sent a self contained note to the Ministry of Home Affairs for taking action against Krishan Mohan,the then home secretary UT and Vivek Attray,the then Director IT,for departmental lapses,states the closure report submitted by CBI.
Local resident,Vivek Aditya,who had filed a series of complaints with the Central Vigilance Commission (CVC),pertaining to allotment of multi-crore amusement-cum-theme park project,has been summoned by the CBI Special court on March 12 to reply to the report.
The first CBI closure report was rejected by the court of Special Judge,Vimal Kumar,on May 18,2012. A fresh probe was ordered on August 30,2012. As per the closure report,which was scrutinised by Aditya,IAS officer Vivek Attray was examined and his statements were recorded.
The alleged scam involves former UT advisor Lalit Sharma,former home secretary Krishna Mohan,former director (tourism) Vivek Attray and M/s Unitech Limited through its managing director Ajay Chandra. All four were booked on charges of criminal conspiracy,cheating,destruction of evidence and corruption by CBI.
In the first closure report,the complainant Vivek Aditya had filed an application in court claiming that he was the actual complaint and he must be heard before accepting the closure report and that the CBIs officer shown as the complainant was merely a pro forma complainant.
Based on his application,the court refused to accept the closure report. I was summoned by the court today to check the documents. Though I could not do it properly today,I will be doing the same tomorrow, Vivek Aditya told The Indian Express.
The CBIs Additional Superintendent of Police (ASP) Karnail Singh,who is the complainant in the FIR registered by the CBI had no objection to the closure report
The ASP was also the investigating officer in the probe into Filmcity project,in which the CBI also did not find any malafide on part of any of the UT officials.
The FIR registered by the CBI in the multi-crore amusement-cum-theme park project scam said that top UT bureaucrats,in connivance with Unitech Limited,indulged in criminal conspiracy and awarded 73.65 acres of land in Sarangpur village to the firm at Rs 5.5 crore fixed annual licence fee and 1.1 per cent annual revenue sharing. By doing so,the accused have caused “wrongful loss to the government,as per the FIR.
