CBI court gets time till Aug 1 to decide on framing charges

Cash-at-judge’s-door scam: Solan land deal smokescreen created by accused: CBI cousel

As requested by the special CBI Court,Chandigarh,the Punjab and Haryana High Court on Thursday extended the deadline to decide on the issue of framing charges against all accused involved in the Cash-at-Judge’s-door scam.

The court,now,has time till August 1 to decide on the issue of framing charges against Justice (retd) Nirmal Yadav and other accused in the case. Since the previous deadline,set by the High Court,had expired on July 21,special CBI Judge Vimal Kumar had written a letter to the High Court,earlier this week apprising the High Court that arguments in the case were yet to be concluded.

Meanwhile,in the CBI Court on Thursday,CBI special public prosecutor Anupam Gupta stoutly rebutted the challenge thrown to grant sanction to prosecute Justice Yadav in the case. Taking the court through an array of official communications of the offices of President of India,Central Bureau of Investigation and Chief Justice of India,Gupta said that there was no pre-existing order of the Chief Justice of India considering or refusing sanction to prosecute Justice Yadav.

Gupta said that two explicit orders,granting permission to investigate the scam and sanction to prosecute Justice Yadav,were passed by the office of Chief Justice of India (CJI). On September 4,2008,the then Chief Justice of India had granted permission to the CBI to investigate the scam. The permission was given after the CBI director had written to the CJI.

Gupta further stated that “after conclusion of investigation”,former Chief Justice of India S H Kapadia had granted sanction to prosecute Justice Yadav on July 28,2010. Gupta made it clear that there was nothing on record,in writing,to even remotely suggest that there existed any previous order (by the CJI) denying sanction to prosecute Justice Yadav.

With regard to the defence taken by Delhi businessman and co-accused Ravinder Singh that he had sent Rs 15 lakh for the Solan land deal,Gupta said that the Solan land was a “smoke screen” created by the accused.

The CBI prosecutor said that the “end utilisation of Rs 15 lakh was in Solan” but the money was given to Justice Yadav for the judgment,pertaining Panchkula plot,she had passed in favour of client of lawyer Sanjiv Bansal,co accused in the case,argued Gupta.

Arguments in the case are likely to conclude on Friday,after which the special CBI Court will decide on issue of framing charges against the accused.
