Additional district judges empowered to decide NDPS cases

Punjab and Haryana High Court has decided to empower all the Additional District and Sessions Judge (ADJs) of the UT District Courts.

In a significant development,the Punjab and Haryana High Court has decided to empower all the Additional District and Sessions Judge (ADJs) of the UT District Courts to decide cases pertaining to Narcotics Drugs & Psychotropic Substances (NDPS) Act.

The development took place during the resumed hearing of a public interest litigation (PIL) arising out of a suo motu notice taken by the High Court on a letter written by a lower court judge. The lower court judge had written to the High Court about the rising number of cases of NDPS in the lower court.

A total of 174 cases pertaining to NDPS Act are pending before the lower court,the judge had said. He had added that there are nearly a thousand cases pending in his court which makes it very difficult for the judge to do away with all the cases expeditiously. At present only one ADJ is empowered to decide NDPS cases.

Taking note of the grievance raised by the judge,the High Court has decided to empower all the ADJs in the lower court to decide such cases.
