Undertrial gets bail to guide son for his higher studies

The Gujarat High Court has recently granted bail to an undertrial prisoner after his son approached the court to release his father to guide him to decide on which course to follow after he cleared Class XII (science stream) examination this year.

A single-judge bench of the HC comprising Justice Akil Kureshi passed an order in this regard earlier this week. The undertrial prisoner has been identified as Baldev Rabari. He has been lodged in jail for the past few years and released on several occasions on temporary bail.

However, this time Baldev’s son Mitesh had approached the court on behalf of his father. Mitesh sought bail for his father as he has recently cleared Class XII (science stream) examination from Gujarat Board and wanted guidance from his father to decide on “proper” course to follow after that.

In fact,Mitesh remained personally present before the court presided over by Justice Akil Kureshi and presented his case. After Mitesh’s oral presentations, the court ordered to release his father on temporary bail for seven days and on condition that he would deposit Rs 5,000 with jail authorities.

“The applicant, son of the undertrial prisoner,is present before the court. He said his father, who is in jail for couple of years, has been released on several occasions and always surrendered on time. He himself has passed Standard XII Science Examination from Gujarat Board and for securing admission in proper course his father’s guidance is required,” the court observed.
