(File Photo)The next of kin of deceased members in the Morbi bridge collapse under the banner of the Tragedy Victim Association of Morbi has written to the Prime Minister’s office, union minister of state of ministry of law and Gujarat chief minister’s office requesting the removal of recently appointed additional advocate general and public prosecutor Mitesh Amin “from all the matters related to Morbi Bridge tragedy”, for not opposing the bail plea of key accused Jaysukh Patel.
Terming it to be “completely surprising and spine chilling”, the association blamed Amin for adopting “a loose and stigmatic approach while representing the state of Gujarat in opposing the bail of the Managing Director (of Oreva Group) Jaysukh Patel, despite the fact that the said matter holds “a grave sensitivity.”
“It would not be out of place to say, that the arguments commenced by Shri Amin also reflected the stands of the state government, which seems to be completely contrary than what had been promised..,” the association’s representation read, adding that at the time of the incident in October 2022, “staunch promises” were made by the state government “to leave no stone unturned in the investigation of the cause and also in making strong representation of the same..” and that the state will adopt a “strict approach” against the perpetrators of the incident.
During the hearing of bail plea of the key accused Jaysukh, prosecutor Amin had suggested the court to exercise its own discretion and had not opposed the bail plea categorically.
“In fact, the prosecutor had submitted that if one summarises recent past judgments of the Supreme Court, then discretion in favour of the accused can be exercised taking into account factors such as whether there has been a certain period of incarceration, whether investigation has been completed, if there are a large number of witnesses listed for the trial and if there is any possibility of running away, given that Jaysukh is a businessman. The prosecutor had indicated that discretion can be exercised in favour of the accused subject to stipulation of conditions,” the letter read.
