HC issues notice to Modhwadia over road encroachment

The PIL had been moved by a resident of Porbandar, Prakash Unadkat.

The Gujarat High Court has issued notices to state Congress president Arjun Modhwadia and several others in connection with a public interest litigation (PIL) that accused him of encroaching on a public road in Porbandar city. The PIL had been moved by a resident of Porbandar, Prakash Unadkat.

According to the petitioner’s lawyer Pranav Dave, “Modhwadia and his brother Ramdevbhai have encroached upon a public road in Porbandar outside their residence by constructing a structure for their personal security personnel. The Chief Officer of Porbandar nagarpalika had, in November 2013, served notice to them, directing them to remove the encroachment. However, the authorities took no steps to remove the encroachment. So, we have moved the PIL.”

Apart from Modhwadia and his brother, Porbandar nagarpalika’s Chief Officer, Porbandar Collector, Porbandar District Superintendent of Police, Director of Municipalities and Secretary of Revenue Department have also been issued notices last week by the division bench, comprising Chief Justice Bhaskar Bhattacharya and Justice J B Pardiwala that issued the notice to Modhwadia.

The matter has been posted for further hearing on February 6.
