The Central Bureau of Investigation (CBI) on Friday sought extension of the date for the hearing of a bail petition filed by former minister Amit Shah in connection with the Sohrabuddin Sheikh fake encounter case,which is slated for September 22.
The CBI moved the application citing preoccupation of its counsel,K T S Tulsi,in another matter related to the same case at the Gujarat HC on September 22.
The special CBI court kept hearing on the application on Monday even as Shahs lawyer,Mitesh Amin,objected to any extension of the hearing saying it is a question of personal liberty of the accused.
He said the CBI must make some alternate arrangement to deal with the issue.
On Thursday,hearing on Shahs bail application had commenced,and his counsel and senior Supreme Court lawyer,Ram Jethmalani,had argued for around three hours. The hearing was adjourned to September 22.
Tulsi,who is representing the CBI in the petition,is also appearing on behalf of the probe agency at the HC in the hearing of a petition for awarding pardon to an accused in the case and turn him an approver.
The matter has been slated for hearing on September 22.
Probe agency moves plea to record voice samples of accused cops
The Central Bureau of Investigation (CBI) has moved an application before the special CBI court seeking permission to record voice samples of five accused in the Sohrabuddin Sheikh fake encounter case. The agency has moved the application for the authentication of certain evidence available with it in audio and video format. The five accused have been identified as Abhay Chudasama,Dr Narendra Amin,N V Chauhan,Yashpal Chudasama and Ajay Patel.
The court has issued notices to three of the five accused and kept it for hearing on September 20. The other two,Yashpal Chudasama and Ajay Patel,are still absconding.Sources said the CBI has electronic evidence discreetly collected by key witnesses,Raman Patel and Dashrath Patel,and accused Dr Amin,in which the direct involvement of former minister Amit Shah emerges out.
CBI opposes cops plea
The CBI has opposed an application moved by suspended IPS officer Rajkumar Pandian,who is one of the prime accused in the Sohrabuddin case,to provide him with the CBIs case diary. Citing a precedent set by the Gujarat HC,Pandian had demanded a copy of the case history till the date of submission of chargesheet. The CBI has opposed it saying that the further investigation is on and so they are not violating the HC judgment. The next hearing will held on September 22.
