Property mutation case: HC summons DC, finance officer; UTsuspends public prosecutor

The action was taken on the recommendation of the Home Secretary for grave dereliction on Singh’s part.

The Panjab and Haryana High Court on Tuesday summoned Chandigarh Deputy Commissioner Ajit Balaji Joshi and finance and accounts controller in a case related to non-compliance with court orders to mutate (transfer) the property of a Sector 9 resident, Sanjay Majithia, in his name.

In the meantime, the Chandigarh Administration on Tuesday suspended public prosecutor Hukam Singh for not properly conducting the case in the Chandigarh district courts related to the transfer of property resulting in non-compliance with court order. The action was taken on the recommendation of the Home Secretary for grave dereliction on Singh’s part.

Justice Rajiv Narain Raina has summoned the Deputy Commissioner and finance and accounts controller in the high court on November 30 since the Chandigarh Estate Office had earlier written a letter to Sanjay on November 3 to pay stamp duty fee of around Rs 1.49 crore for mutation of property but later when the Chandigarh district court on November 9 attached the UT Administration’s property, including the Finance Secretary’s official car, Sanjay was issued a mutation letter on November 13.

Sanjay, son of former high court judge G R Majithia, had moved the high court saying that the Chandigarh Administration was not transferring property in his name despite the court directions.

The court has raised questions that despite the Chandigarh Finance Secretary’s personal appearance on October 12 in the high court and an assurance that functioning of the Estate Officer will be streamlined, nothing seems to be working well. The court has also questioned on what basis the stamp duty is being levied in such cases.
