Pandya case: SC turns down plea to question Modi

The Supreme Court on Wednesday dismissed a petition filed by Vithal Bhai Pandya,the father of former Gujarat home minister Haren Pandya,seeking a direction to the Central Bureau of Investigation for questioning Chief Minister Narendra Modi in connection with his sons murder on March 26,2003.

There should be some basis for such speculation, the Bench,led by Chief Justice K G Balakrishnan,said,adding that there should be some connecting link to justify such an assumption.

Declining to issue any direction in this regard,the Bench,also comprising Justices P Sathasivam and B S Chauhan,said: We are very sorry that a father has to come here… anyone can visualise the feeling of a father.

The remarks came as Vithal Bhai started arguing himself,seeking a direction to the investigating agency. Later,senior advocate Magan Bhai Barot was allowed to make further submissions about the case on his behalf.

It was contended that the CBI was not examining some of the main witnesses in the case,including Harens wife Jagruti Ben,which would help in going into the root of the conspiracy,allegedly involving Modi.
