A few moments after Luigi Mangione, suspect in the killing of UnitedHealthcare CEO Brian Thompson, was handcuffed at a Pennsylvania McDonald’s in December last year, a police officer who was searching his backpack found a loaded gun magazine wrapped in a pair of underwear, body-camera footage allegedly showed during a trial in Manhattan Criminal Court on Monday, AP reported.

The event recounted in court convinced the police in Altoona, Pennsylvania that he was the man wanted in the killing of UnitedHealthcare CEO which took place in Manhattan five days earlier. One of the police officers was heard saying in the body-cam footage, “It’s him, dude. It’s him, 100%,” as officer Christy Wasser, who was searching Mangione’s bag, held up the gun magazine.

Wasser is a senior police officer who testified on the fourth day of the pre-trial hearing as Mangione sought to restrict prosecutors from using the gun magazine, a 9mm handgun, a notebook and other subsequent evidence found during bag search. Wasser’s testimony highlighted the chronology of events that took place after Mangione was spotted at the McDonald’s.

In the defence, Mangione’s lawyers argued that the evidence collected by police should be excluded from the case as police didn’t have a search warrant and the authorities lacked to justify a warrantless search. However, prosecutors stated that the search was legal and the administration had obtained a warrant eventually.

Mangione, 27, has pleaded not guilty to the charges of murder pressed by the state. Prosecutors have said that the handgun found in backpack during Mangione’s apprehension last year matches the firearm used in the killing of Brian Thompson. Mangione’s notebook suggested his dislike towards health insurers and it detailed about killing a CEO at an investor conference.

Brian Thompson, UnitedHealthcare CEO, was killed as he walked to a hotel in Manhattan for an investor conference. Footage obtained through CCTV showed a masked gunman shooting Thompson from behind.
