The Supreme Court on Monday sought the Centres response on a PIL for directives to the government to raise the issue of brutal killing and beheading of two Indian soldiers by infiltrating Pakistani troops before the International Criminal Court and sever all ties with the neighbouring country for violations of Line of Control.
A Bench led by Justice P Sathasivam sought responses from the ministries of Home and External Affairs within four weeks,detailing the steps taken by them on diplomatic and international level over the unfortunate killings of the Indian soldiers.
The court also decided to hear this matter along with a petition moved by the father of Kargil martyr Captain Saurabh Kalia,who was reportedly subjected to brutal torture in captivity by the Pakistan Army in 1999. His mutilated body was returned to the Indian authorities after three weeks of his captivity. In this matter too,the apex court had issued notices to the Centre.
The PIL by Sarwa Mitter has sought courts intervention on account of inaction by the government in taking steps at international and diplomatic platforms against the barbaric killings of two jawans on January 8.
The Bench was initially reluctant to admit the PIL since the petitioner had not approached the government with the grievances.
It observed that the court could not presume inaction on the part of the government when the petitioner had not approached proper authorities with a representation.
The petitioners counsel,however,responded that there were statements by ministers concerned to demonstrate that the matter had not been taken to an international court till date and that it would be hence proper to ask the Centre to appear in the matter and explain what all they have done about the incident.
