The Cabinet on Wednesday approved amendments to the Prevention of Corruption Act that make it mandatory for sanction to be taken from competent authority before prosecution of retired bureaucrats in cases of corruption.
Briefing reporters on the subject,Finance Minister P Chidambaram said provisions of seeking sanction for prosecution of retired public servants was included to give them protection and ensure that they are not falsely implicated for something which they might have done with good intention in office. A timeframe has been set,he added,for granting or refusal of such a sanction.
He said the amended Act incorporates provisions to confiscate and forfeit property illegally acquired by a corrupt public servant. For the first time,a provision for liability of a commercial entity for failing to prevent bribery of a public servant has been incorporated.
