
Offering relief to a head constable stripped of his job due to alleged misconduct, a city court has held his termination as improper and directed the Central Industrial Security Force CISF to pay full back wages to him along with other service benefits. Dismissing the appeal of CISF in a recent order, Additional District Judge Rajiv Mehra directed it to consider taking Narain Singh back in the regular service if his age for superannuation had not expired.
8220;On consideration of the overall records, it would be unjust and unfair if the finding of the CISF8217;s Inquiry Officer is allowed to stand against Singh and based upon that, the removal order is allowed to remain in force,8221; the ADJ said.
Singh, posted as a head constable with the CISF Unit at ITI Mankapur in Uttar Pradesh, was removed from his job in November, 1987 following a departmental inquiry, which had held him guilty of misconduct and indiscipline. He had remained absent from duty on September 28, 1986 without any information and visited a place outside his Unit without his senior officer8217;s permission, the disciplinary authority had averred while terminating him.
Singh, on September 28, was, however, arrested by the GRP Police at Mankapur Railway Station in connection with a cheating case and he alleged before the lower court that he could not report back to duty because of his detention. He further adduced documents to prove that the criminal case against him was dismissed for want of evidence, further pointing that there was no misconduct of any kind on his part.
