NEW DELHI, FEBRUARY 6: A day after senior BJP leader Rajmata Vijayaraje Scindia’s terhavin — 13th day after death — a battle royale for her property is likely to erupt tomorrow with her secretary, Sardar Angre, going public with her will.
Her son, Madhavrao Scindia, has already procured an interim injuction from a district court against “alienation of her property” as per provisions of Primogeniture — a customary law bestowing all rights of property of a royal family on its first born. The Rajmata’s daughters, on the other hand, are learnt to be demanding division of the property as per provisions of the Hindu Succession Law.
Sardar Angre told the The Indian Express that the will was an 11-page document which had been written by the Rajmata in her own handwriting in 1986 and that it’s the only will.
Sources close to Sardar Angre claimed the Rajmata had in the will clearly defined her relationship with a number of persons associated with her, including Dr J.K. Jain and Angre himself. She has also confirmed “gifting” some prime land of Scindia Potteries in Sarojini Nagar here to Dr Jain, they claimed.
Jain is already involved in a dispute with the Rajmata’s daughters, including Union Minister Vasundhara Raje, over the three-acre Sarojini Nagar plot which houses his Jain Studios. He blames Vasundhara Raje for depriving him of a re-nomination to the Rajya Sabha only because he refused to vacate the plot.
But Madhavrao Scindia’s counsel, Dr Abhishek M. Singhvi, claims that a number of cases in the country had already been decided on the basis of Primogeniture, which has as much legal sanctity as part of customary law as any other law.
“Since the injuction obtained by me on behalf of Madhavrao and his family has been upheld by the high court as well as Supreme Court many years ago, no property listed in the suit can be given to anyone else,” said Singhvi.
