
CHANDIGARH, June 9: Issuing notice of motion for July 8, Justice H.S. Brar and Justice V.M. Jain of the Punjab and Haryana High Court have stayed the dispossession of Rattan Kaur from Quite Office number 14 in Sector 35.
In her petition against the UT Administration, the Chief Administrator, besides the Estate Officer, Rattan Kaur had earlier sought the quashing of an order directing the petitioner quot;to remove the structure erected on the said site within 15 days and for restoring the possessionquot;.
Further directions to the respondents against dispossessing the petitioner from the property till the pendency of an appeal before the UT Chief Administrator was also sought.
Going into the background of the case, the petitioner had stated that site number 14 in Sector 35 was allotted by the Estate Officer on February 25, 1990 to the petitioner and other allottees on quot;lease hold basis for a total consideration price of Rs 3,670,000quot;. The petitioner, counsel Ashok Sehgal added, paid 25 per cent of the total premium and constructed the building over the sitequot;. The allotment, he further added, was cancelled on July 1, 1992 due to non-payment of instalmentsquot;. On May 24, the petitioner applied for retransfer under Rule 21-A before the competent officer.
