
CHANDIGARH, JUNE 21: K.K. Jerath, presently lodged in Burail jail in a fresh FIR dated March 16, today filed bail application in the court of City District and Sessions Judge B.S. Bedi. The bail application will be taken up here tomorrow.
The applicant asked for bail on grounds that the FIR was lodged simply to prolong his detention. quot;The FIR was lodged on March 16 but the arrest was made three months later, on June 15,quot; he stated.
The applicant stated that same allegations had been levelled in FIR 1 of 1999. He added that this FIR was a reproduction of the enquiry report submitted by Deputy Home Secretary Sanjeev Khirwar on June 16, 1998. The said enquiry had been conducted on a complaint made by J.S. Sawhney.
Bail was sought to be granted on grounds that investigation into the allegations made in FIR 1 was being conducted and trial was going. The next date of hearing is July 27. In this view the applicant stated that quot;the present FIR is nothing but abuse of court processquot;.
C.J. Rai8217;s bail plea taken up
The bail application moved by C.J. Rai, who was arrested on June 17 in FIR 1 dated March 16, in which five persons in all have been named, was today taken up by UT District and Sessions Judge B.S. Bedi. Notice to the state had been issued for today on the application which was filed earlier.
The counsel for Rai today asked the court for some time and arguments on the application were adjourned.
Suit of damages against KC Residency proprietor
A local resident filed a suit against proprietor and manager of hotel KC Residency claiming damages on account of the distress he had to undergo due to negligence on their part. Earlier notice to the two was issued for October 5 by UT Civil Judge junior division Paramvir Nijjar.
In his suit the plaintiff, B.C. Mahendru, stated that he had booked the hotel with a view to perform marriage ceremony of his niece whose parents lived abroad and due to some reason could not come for the wedding. The said booking was done for May 5.
It was, however, alleged that on the said date when he reached the hotel to receive the baraat, he slipped twice on the hotel floor which apart from being covered with granite tiles, was littered with wet rubbish. Mahendru added that he suffered from multiple fracture in his leg. He stated that the hotel manager was informed immediately but he did not bother. Later he was taken to the City Hospital and his leg was attended to.
Further adding that an expenditure of Rs 15,000 had been incurred, the plaintiff stated that due to negligence of the hotel staff he could not even perform kanyadaan of his niece.
The plaintiff claimed damages on account that despite paying for booking he suffered from multiple fractures due to negligence of the staff. More so, he could not attend the wedding.
Lotteries case: Notice to state on bail pleas ALL the 34 accused under Sections 4, 5, 7 of the Lotteries Regulation Act, 1998, who were declined bail by City Judicial Magistrate Ist Class A.K. Bishnoi here on June 19, today applied for bail in the court of UT District and Sessions Judge B.S. Bedi.
Taking up bail pleas of the accused the Sessions Judge issued notice to the state on the same for June 28. The prosecution will now submit its reply to the bail applications on the next date.
It may be recalled that the city police had rounded up 34 people for allegedly selling banned lotteries in the city and also for cheating people by charging more price than the one quoted on the lottery.
Earlier the bail to the accused had been declined by A.K. Bishnoi on grounds that the allegations levelled against them were of a serious nature and the investigation into the same was pending.
The accused had also been booked under Sections 420, 406 and 120-B IPC and had earlier been remanded to judicial custody till July 2.
