In a surprise move, the J. Jayalalithaa government has decided to withdraw the POTA case against MDMK leader Vaiko, after detaining him for 577 days.

In a petition, presented before the POTA court last evening, public prosecutor S. Jayakumar conveyed the government’s intent to withdraw the case against Vaiko and eight other MDMK partymen. ‘‘I have presented the petition to withdraw the case based on a letter from the state government,’’ Jayakumar said.Judge L. Rajendran is expected to pass orders on the petition on August 26.

For Vaiko, who is on a padayatra in southern Tamil Nadu, it was good news. He was arrested on July 11, 2002 under the Prevention of Terrorism Act for allegedly supporting the LTTE at a public meeting and was released only 19 months later. The withdrawal of the case comes as a surprise because the state had earlier maintained that the POTA review committee’s recommendation to revoke the case against Vaiko was not binding. Now, just a few days ahead of the SC’s next hearing on Vaiko’s petition seeking withdrawal of the case, the state has quietly decided to drop the charges.
