CALCUTTA, July 31: Setting aside the trial court order, directing the Comptroller and Auditor General (CAG) to probe the functioning of treasuries and Personal Ledger Accounts (PLA), the Calcutta High Court here today upheld that the magistrates would oversee the functions of treasures.

A Division bench comprising Justic Tarun Kumar Chatterjee and Justice Siddeshar Narayan, passing the judgment also upheld another directive of the trial court which said that the magistrates must also oversee that no PLA document is tampered with.

The Division Bench has passed the judgement on two appeals made by the State Government and CAG praying for a stay on the interim order on a writ petition filed by the West Bengal Youth Congress Chief Mamata Banerjee alleging illegalities regarding the opening of PLAs in the State.

The division Bench however, has given liberty to the writ petitioner to make an application for interim order praying for an inquiry by the CAG and submission of the report. And the trail court will decide that application after giving chance to file affidavit to the respondents.
