The Central Water Commission (CWC) filed an affidavit on the Cauvery issue before the Supreme Court today, stating that a ‘‘report of the assessment of ground realities has not been formalised as yet’’, and that it would report back to the court as soon as it is done.

It states that since the figures available at Mettur are not directly monitored by the CWC, the ‘‘question of compliance of the court order would have to be ascertained on the basis of the figures given and the material placed by these states.’’

This clearly shows that Tamil Nadu CM J. Jayalalithaa’s refusal to allow the Cauvery Monitoring Committee (CMC), deputed by the PM to verify both states’ claims and counterclaims on current water levels, had rendered the panel’s mission futile.

The CMC couldn’t reach any conclusion on Karnataka’s compliance of the court’s orders to release 1.25 tmc ft of water to Tamil Nadu daily between Sept 4 and 8. Nor was it able to reflect the ground realities as it existed in the two states in terms of water storages in their respective reservoirs.

After meeting Vajpayee last week in Delhi and complaining that Karnataka’s refusal to release Cauvery water had depleted inflow into Mettur reservoir, Jayalalithaa refused to allow the CMC to visit Mettur saying it would be ‘tantamount to contempt of court’’.

She also refused to attend the CMC meeting in Bangalore on Sept 24 saying that the matter was sub-judice. But the paneel did visit the four Cauvery basin reservoirs in Karnataka on Sept 24 and 25.

The apex court will continue hearing in the case on Monday when Krishna is expected to make a personal appearance after Tamil Nadu named him in the contempt petition it filed against Karnataka.
