
Cheque bouncing case: Garware8217;s plea discharged
A metropolitan magistrate recently rejected the discharge application of industrialist Chandrakant Garware in a Rs 25 lakh cheque bouncing cheque case dating back to 1994. Garware has filed a revision application in the Sessions court challenging the magistrate8217; order.
Jayheet Investment Private Limited had invested Rs 25 lakh by way of inter-corporate deposits from December 9, 1993 to March 7, 1994 with Garware Paints Limited. The amount, along with 21 per cent interest, was to be repaid by the paint company. Post-dated cheques issued by the Bank of Rajasthan8217;s Andheri branch to the tune of Rs 25.99 lakh including interest which were issued to the investments firm were all dishonoured with the message 8220;insufficient funds8221;. Thereafter, several reminders were issued, but Garware Paints failed to repay the amount. A case was filed at the 10th Metropolitan Magistrate8217;s court which was later transferred to the 44th Magistrate8217;s court.
Garware thenmoved the court of Metropolitan Magistrate U S Mendjodge seeking discharge from the case by recalling the process issued against him. In his discharge application, Garware claimed that he was not concerned with the cheque as he was not in charge of the company affairs at the time when the cheques were dishonoured, and that he had been suffering from a heart ailment since 1991.
The magistrate observed that since Garware had earlier withdrawn an application seeking discharge in the case in the Bombay High Court, there has to be a prima facie case against him. 8220;The fact that he has withdrawn the application itself reveals that Garware did not want to challenge that order by which he was made an accused in that case,8221; observed the judge. Garware in his revision application prayed that the order of the magistrate be set aside as it is illegal, improper and bad in law. The matter is being heard by Additional Sessions Judge Abhay Thipsay and is now posted to April 21.
15 infants at risk of mentaldisability
n FIFTEEN infants at the risk of being mentally disabled are born everyday in the city of Mumbai alone and one such child is born every minute in the country, according to a report released by Association for the Welfare of Persons with a Mental Handicap AWMH in collaboration with Nirmala Niketan College of Home Science.
The report titled, Needs and Coping Strategies of Parents of Mentally Disabled Individuals8217; states that currently there are two crores such persons in India of which two lakhs are in Mumbai.
8220;Sterilisation of the mentally disabled is a sensitive area where parents still want a lot of debate,8221; according to Dr Suneeta Kulkarni, who conducted the research, 8220;Should sterilisation be carried out on both boys and girls or only on the latter? The parents of special children also want a debate on whether or not to have other children, care of the disabled after the parents8217; death, marriage and sexual companionship and employment in mainstream organisations8221;. The AWMH hasbought four acres of land in Pune to build a residential home for the disabled whose parents have died.
